Welcome to Learnitivity ("we", "our", or "us"). By accessing or using our website, services, or any content made available through our platform, you ("user", "you") agree to be bound by these Terms and Conditions. If you do not agree to these Terms, please do not access or use the platform.

1. Use of Services

Your account is personal and non-transferable. You must not share login credentials with others or allow others to access the platform using your account.

We may impose usage limits (e.g., daily message caps) and expect you to comply with them.

2. Account Suspension and Termination
We reserve the right to suspend, restrict, or terminate your account and access to our services at any time, with or without prior notice, at our sole discretion, particularly if you:

Misuse or attempt to circumvent platform limits or security

Use automated tools, bots, or other unauthorized access methods

We are not responsible for any loss or data associated with account suspension or termination.

3. AI-Powered Responses Disclaimer
Learnitivity uses third-party AI APIs to generate educational responses. The content is provided “as-is” and “as-available”.

While we strive to maintain quality, we do not warrant the accuracy, completeness, reliability, or suitability of AI-generated responses.

You must not rely on AI outputs for critical decisions, including academic submissions, legal opinions, medical advice, financial actions, or personal safety.

We are not responsible for consequences arising from reliance on AI content.

4. Payments and Refunds
Payments are processed securely through Razorpay, Google Play Billing, or Apple In-App Purchases, depending on the platform used.
For purchases made via Google Play or Apple In-App Purchases, refunds are subject to the respective platform’s policies and are typically only available within 48 hours of purchase. The amount refunded, if any, will be determined by the platform and may not be full.
For payments made directly via Razorpay, we offer a full refund within 15 days of purchase. To request a Razorpay refund, email us at learnitivityinfo@gmail.com.
Refunds are not provided for misuse of the service or requests made outside the stated refund windows

5. Limitation of Liability
To the maximum extent permitted by applicable law, Learnitivity and its affiliates, officers, employees, and partners shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:

Loss of data, revenue, or profits

Downtime or service unavailability

AI inaccuracies or errors in educational content

Unauthorized access to or alteration of user content

Any third-party services or content accessed via our platform

You use our services at your own risk. No oral or written information or advice shall create any warranty not expressly stated in this agreement.

6. Indemnification
You agree to indemnify, defend, and hold harmless Learnitivity and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your:

Violation of these Terms

Violation of any law or rights of a third party

7. Modifications
We may revise or update these Terms at our discretion. Any changes will be effective immediately upon posting. Your continued use of the platform constitutes your acceptance of the modified Terms. We recommend reviewing this page periodically.

8. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ernakulam, Kerala.
